Palm Coast man charged with shooting at alleged burglar

Two Palm Coast men who knew each other well got into an argument May 30, leading the State Attorney's Office to file charges against both of them this week.

Stephen Metcalf, 31, of Palm Coast, was charged Sept. 5, with attempted burglary of an occupied dwelling and resisting arrest without violence, for an incident that occurred May 30.

The written statement by the arresting officer reads that Marc Matthew Barbee called 911 when he heard someone outside of his residence trying to pry open his rear sliding door. There was also an attempt made on the master bedroom window, an investigation revealed. Barbee then grabbed his firearm and turned on all of his interior lights.

It was reported that Metcalf ran from the residence and tried to flee the scene in his pickup truck. Barbee said the alleged burglar tried to run him over with his truck, so he fired three rounds into the rear of the vehicle.

Metcalf was later apprehended when he was seen leaving the area of the crime at a high rate of speed.

According to the statement written by the arresting officer, two .40-caliber bullet casings were found on the roadway near the swale at Brittany Lane. That shows that Barbee was either in the swale or in the roadway when the shots were fired, according to the statement.

“Either way, the defendant could not have been on his property when he fired his gun,” the statement said. In a 911 call, Barbee, 38, made no reference to being in danger or that anyone was trying to back over him with a truck.

The State Attorney's Office has charged Barbee with shooting into an occupied vehicle, for his part in the May 30 incident.

No trial date has been yet.
