Erick Niemi, who currently faces charges of the May murder of Leonard Lynn, also has a pending case against him for allegedly borrowing a generator and refusing to return it.
Niemi was charged in 2012 with the grand theft of the generator, and pled no contest to the charges in February. He was placed into a pretrial intervention program, in which felony charges are dropped upon completion of the program, if certain terms are met.
Part of the terms of Niemi’s intervention program was that he would refrain from criminal activity, so when he was arrested in June for Lynn’s murder, Niemi’s grand theft case was reopened. Niemi was set to be sentenced Monday morning, but Circuit Judge J. David Walsh agreed to suspend the sentencing until after Niemi completes his murder trial, a request put forth by Niemi’s defense attorney.
Niemi is currently being held on no bond in the Flagler County Inmate Facility as he awaits trial. If convicted of murder, he could be sentenced to death.
“We may as well let this ride along,” Walsh said. “He’s already in jail; he’s not going anywhere.”
