The Flagler Beach City Commission has approved an ordinance adjusting setback requirements for yard structures like sheds and pool decks.
The city’s land development code used to require “accessory structures” like pools and gazebos to be at least 10 feet from rear or side lot lines of a property, but the commission, in a unanimous vote Thursday, March 27, adjusted that to five feet.
“If it’s an unattached structure, I felt that 10 feet from the back of the property line was excessive, so that’s why I suggested the five feet,” said Commission Vice Chairman Marshall Shupe. “Especially when we look at the price that somebody pays for a 50-foot-wide lot that may only be 100 feet deep, and they want to put a structure on it, and they’re throwing away 10 feet of that property.”
Thursday’s vote was the second and final reading for the ordinance.

The commission appointed Kim Carney its new Chairwoman and Marshall Shupe its Vice Chairman in a meeting on March 13.
