Palm Coast resident Christian Pence, 30, is facing an assault charge after his 57-year-old neighbor said Pence’s dogs charged him and Pence threatened him when he tried to defend himself.

The victim, 57-year-old James McCabe, was walking his 14-year-old, 18-pound miniature pinscher on Columbus Court on May 15 when two yellow labs came running out of Pence’s open garage, approaching McCabe from either side, he said, according to a Flagler County Sheriff’s Office report.

This was the third such incident with Pence’s dogs, he said.

McCabe, who is disabled, waved is cane to fend off the labs, which were barking and a few feet away, he told deputies.

Christian Pence came out of the house and said his dogs wouldn’t hurt anyone, but after he secured them, he returned to McCabe, stood about two feet from him, and said, “I will kick your old man (expletive) if you don’t leave my animals alone,” McCabe told deputies.

McCabe walked back to his home and called 911, and told deputies he wanted to press charges for assault. The Sheriff's Office has forwarded an assault charge on Pence to the State Attorney's Office, Sheriff's Office Spokeswoman Deputy Paula Priester said.

Jail records show Pence was arrested in Flagler County three times in the past, on drug-related charges and on charges of driving under the influence and driving with a suspended license.
