A man accused of threatening a 67-year-old Palm Coast woman's life during a burglary has pleaded no contest and will be sentenced Jan. 25 with a co-defendant.
The man, 27-year-old South Daytona resident Daniel Evans III, pleaded no contest to a count of burglary with assault or battery in a Dec. 10 docket sounding, and the prosecution agreed not to pursue a home invasion robbery charge, 7th Judicial Circuit representative Ludmilla Lelis said.
Evans had entered the victim's house by knocking on the door and, when she answered, shoving it open so forcefully that she was thrown to the floor, according to Sheriff's Office reports. He told her he'd kill her if she looked at him, and then stole money and credit cards from her purse, according to the reportsد.
Evans will be sentenced in a 9 a.m. hearing Jan. 25 with alongside Carisa Noel Hall, a 23-year-old South Daytona woman who was a former roommate of the 67-year-old victim, and who is charged with a count of principal to burglary with a battery in connection with the Aug. 3, 2014 burglary. Hall entered a plea of no contest in August, and the State Attorney's Office also agreed not to pursue a home invasion robbery charge in her case.
Both pleas are open pleas; there is no agreement with the prosecution on sentencing.
