Man charged with DUI in Flagler Beach

A background check revealed that the suspect's driver's license was revoked in 2014 for prior refusal to submit to a lawful breath, urine or blood test.

Law enforcement arrived at a residence in Flagler Beach in reference to a car crash with injuries on the night of Thursday, Dec. 6, according to a charging affidavit released by the Flagler Beach Police Department.

When officers arrived on-scene they saw a black Mercedes Benz in a resident's front yard on South Flagler Avenue. The driver was identified to be Marcio Veloz Ruiz Dermody, 56, of Palm Coast. Officers noted that Dermody smelled of alcohol and had bloodshot, water eyes.

When officers asked Dermody for his license, Dermody fumbled through his wallet for about a minute before he tossed the wallet to the passenger's seat and said "you look for it" to the officers. A background check revealed that Dermody's driver's license was revoked in 2014 for prior refusal to submit to a lawful breath, urine or blood test.

When asked to step out of the vehicle, Dermody opened the car door. Two empty bottles of Pinnacle Vodka were seen at his feet on the driver's side floor board and the key in the ignition. 

He struggled to maintain his balance once standing and failed to perform the field sobriety tests.

He was taken to the Flagler County Jail and charged with driving under the influence with property damage, among other charges.
