A 23-year-old Palm Coast man has been charged with breaking into a house in Palm Coast's P-Section and committing sexual battery on his girlfriend June 26 in what he told deputies was an attempt to see if she'd slept with another man.
The suspect, D'Marcus Boyd, admitted to a deputy that he broke the window of his father's Pepper Lane home, where he'd lived before his father kicked him out, according to a Flagler County Sheriff's Office charging affidavit. His younger brother saw him and opened the door, and Boyd entered.
He said his brother let him in, while the brother acknowledged opening the door but told deputies he hadn't granted Boyd permission to enter.
The victim told deputies she was sleeping in the converted garage when Boyd burst in.
He confronted her with accusations of infidelity and ripped the covers off her, he later told deputies.
Boyd's older brother arrived at the house and saw Boyd drag the young woman toward the street by her wrist and take her in a headlock.
Boyd released her, and the victim ran into the house, according to the affidavit.
When deputies arrived at the home, they initially charged Boyd with burglary and domestic battery.
The victim then told deputies that Boyd had committed sexual battery against her before he dragged her into the street.
A deputy found Boyd sitting in a driveway, "visibly upset and crying," according to the affidavit.
He said the victim was his fiancee and that unnamed "friends" had said they had video of her sleeping with another man. He confirmed the woman's account of the manner in which he'd touched her and said he'd done so to test if she'd slept with another man.
The victim also told deputies that he'd taken her bank card and her phone on a previous day and had pulled $200 off of her card. He acknowledged having the cash; deputies found $163 in his pocket.
Boyd had previously been arrested multiple times on charges including four 2013 counts of statutory rape over allegations that he'd had sex with a 15-year-old when he was 18. Those charges were dropped.
The same year, he was convicted of felony battery, burglary, contributing to the delinquency of a minor and criminal mischief, among other charges.
He is being held at the county jail on a combined $127,500 bond.
