Three arrested for trespassing, unlawful use of a fire extinguisher and burglary after a midnight swim

Two cousins and a friend were caught on surveillance footage trespassing at the Belle Terre Swim & Racquet Club.

On Monday, July 12, 2021, the Flagler County Sheriff’s Office responded to a call about a Commercial Burglary at Belle Terre Swim & Racquet Club, located at 73 Patricia Drive. The reporting party stated unknown subjects broke into the pool area and sprayed a fire extinguisher on the pool deck.

The reporting party, who was an employee of the club, stated upon arriving to work at approximately 5:30 AM, she observed several pool items floating in the main pool, including a beach ball, a small kids table, pool hoop, and weight. She stated she removed all items from the pool the evening prior, before leaving and also observed a fire extinguisher had been discharged in the outdoor patio table area.

The employee went into the office to review surveillance footage which showed that at 1:31 AM, the headlights of an unknown vehicle were seen entering the parking lot. It also shows three unknown subjects hopping the pool fence. The subjects then located a camera that was facing east towards the main pool area. One subject got behind the camera and tilted it downward towards the ground.

At approximately 1:35 AM, the subjects start swimming in the pool, followed by discharging the fire extinguisher near the patio table area and then disposing the extinguisher. The employee then noticed a red marker on the dry erase board saying “We were here.”

Through investigative techniques, the FCSO Real Time Crime Center was able to develop a possible suspect vehicle. A white Jeep was traced driving throughout Palm Coast, and the owner was identified.

Deputies responded to 73 Pheasant Drive, the address of the vehicle’s registered owner, to speak with Immanuel Malinkovich, who was later determined to be the driver of the vehicle at the time of the incident. When Malinkovich was questioned about the incident, he explained the scenario and stated that they “got bored late at night” and decided to pick up a friend to hang out, stating he “wanted to do something memorable.” He told FCSO deputies that he was accompanied by his cousin, Timothy Kisurin, and a friend named Hannah Mulvehill.

Upon questioning, it was determined that all three subjects climbed over a 5-6ft chain link fence, entered into the pool area without permission and eventually went under a covered patio area to access the fire extinguisher and dry erase board. 

“This is another great example our Real Time Crime Center and good investigative techniques in action,” Sheriff Rick Staly said. “It is also a great example of ‘seeing something, saying something’ and reporting this incident to law enforcement. I hope these three can learn from their poor decision and turn their lives around.”

Due to the totality of the circumstances, all three subjects were placed under arrest for Burglary of an Unoccupied Structure and Preventing the Use of Equipment for Extinguishment of Fire and were transported to the Sheriff Perry Hall Inmate Detention Center without Incident. All three subjects were released and placed under the supervision of Pretrial Services by order of the judge.
